Terms of Service

1. Service description
RealSalesOS ("we", "our", "Service") provides a hosted AI voice receptionist that answers, qualifies, and books inbound calls on behalf of small businesses, primarily pest control companies and dental practices. The Service includes a phone number (or forwarding from yours), a configured AI agent, integrations with calendar/CRM systems, and a dashboard with call logs and transcripts.
2. The 7-day free pilot
New customers receive a 7-day free pilot. During the pilot we provision a real number, train the agent on your scripts, and route live calls. No credit card is required. At the end of the pilot, you may continue on a paid plan or stop with no further obligation. We may, at our discretion, extend the pilot when setup is delayed by data we are waiting on from you.
3. Plans, billing, and overages
Paid plans are billed monthly in advance. Tiers (Solo Operator, Growing Practice, Multi-Location) and included minutes are listed on our pricing page. Minutes used above the included allotment are billed at $0.18/min and itemized on the next invoice. Subscription fees are non-refundable except where required by law or expressly stated.
4. Cancellation
You can cancel at any time from your account dashboard or by emailing billing@realsalesos.com. Cancellation takes effect at the end of the current billing period; we do not pro-rate partial months. You retain access to your call logs for 30 days after cancellation, after which data is deleted per our Privacy Policy.
5. Acceptable use
You agree not to use the Service for: illegal activity, harassment, spam or unsolicited outbound calling in violation of TCPA, fraud, or any use that violates applicable laws (including HIPAA where the Service is used for protected health information without a signed BAA). We may suspend or terminate accounts that breach these terms.
6. Uptime and SLA
We target 99.5% monthly uptime, measured against the AI answering availability of your provisioned number. If we fall below this in a given calendar month, we credit the affected month's subscription fee on a pro-rata basis. Credits are applied to the next invoice; no cash refunds. Scheduled maintenance announced 48 hours in advance is excluded.
7. Intellectual property
You retain all rights to your scripts, logos, and call data. We retain rights to the Service software, underlying models, and aggregated, de-identified usage statistics. You grant us a limited license to process your data solely to operate the Service.
8. Warranties and liability
The Service is provided "as is". We disclaim implied warranties to the maximum extent permitted by law. Our total liability for any claim arising out of or related to the Service is capped at the fees you paid in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost bookings.
9. Indemnification
You agree to indemnify us against claims arising from your use of the Service in violation of these terms or applicable law, including claims by your customers related to your call scripts or business practices.
10. Dispute resolution
These terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved by binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association, except either party may seek injunctive relief in court for IP or confidentiality matters.
11. Changes to these terms
We may update these terms. Material changes will be announced via email at least 30 days before taking effect. If you disagree, you may cancel before the effective date.
